AR 5015: Residence Determination

Residency classification is the responsibility of the office of admissions, registration, and records and will be made within 14 days of applying for admissions.

Students experiencing housing insecurities should contact the admissions office for support to ensure the appropriate residency determination is made. 

The college shall publish the residence determination date and summary of the rules and regulations governing residence determination and classification in the catalog or addenda thereto.

Rules Determining Residence
Classification of student residence for the assessment of tuition and other purposes will be made according to the following definitions:

  1. Residence is defined as a person’s domicile, a person’s true fixed and permanent home and place of habitation. It is the place where they intend to remain, and to which they expect to return when they leave without intending to establish a new domicile elsewhere. Domicile is not established by mere attendance at a college.
  2. International student is defined as a citizen of another country that is in the USA and not here on an immigrant visa.
  3. Out-of-state student is an American citizen or an immigrant who has not established residency in Oregon 90 days prior to the beginning of classes;
  4. In-state student is an American citizen or immigrant who has maintained a residence in Oregon for at least 90 days prior to the beginning of classes.
  5. Changing residence status to in-state requires proof of Oregon residency that began at least 90 days prior to the beginning of classes.
  6. Legal Guardian: A person who by court order has been appointed to act in the place of the parents of the student.
  7. Emancipated student: A student who has attained the age of majority, or a student who is less than the age of majority, but who is financially and otherwise independent and whose domicile or home is maintained independent of their parents or legal guardian.
  8. Reciprocal tuition: Residents of California, Washington, Idaho and Nevada are eligible for in-state tuition.

Determination of Resident Status
A resident is a student who has been a bona fide resident of the state for 90 days prior to the person’s first instructional day of the term for which residency is in question. 

Right to Appeal
Students who have been classified as non-residents have the right to a review of their classification.  Any student, following a final decision of residence classification by the ARR Office, may make written appeal to the registrar within 14 calendar days of notification of final decision by the college regarding classification.

Non-Citizens
The college will admit any non-citizen who is 18 years of age or a high school graduate.

The initial residency classification will be made at the time the student applies for admission. Students may file residency questionnaire forms through the third week of the semester to request a review of their residency status. Final residency determination is made by the admissions, registration and records.

DACA (Deferred Action Childhood Arrivals) and undocumented students
Students residency is based on the physical location they are residing at and students who are undocumented or on DACA will be granted residency for tuition purposes based on this. 

International Student: A citizen of another country other than an immigrant visa.
